Supervision rule

Every salesperson must be properly supervised and managed by an agent or branch manager (REAA s 50). James Law is the company's only agent licensee and every other licensee holds a salesperson licence, so he (JLR-02) is the named supervisor of every salesperson, whatever their job title. Kim Diack, Michelle Kennedy and Rosh Daji help to supervise (marked helps supervise): they check allocated salespersons day to day and James Law reviews and signs every check. The build refuses any licensee role whose supervisor is not held only by an agent or branch manager. Confirm each licence on the REA public register.

Open decisions

1. Record the company's agent licence number (James Law Realty Limited, licensed under the REAA 2008) and its NZ company number so they can be shown with the name on the website, advertising and documents (REAA s 121).
2. James Law is the sole director, the Managing Director (JLR-03), the Licensed Agent Officer (JLR-02), the only agent licensee and the Marketing and Technology lead (JLR-07) (owner, 25 Oct 2026).
3. Decide who heads Commercial and Industrial (JLR-30): one of the two Regional Directors or a new appointment.
4. Supervision: James Law (JLR-02) is the legal supervisor of every salesperson (REAA s 50). Kim Diack, Michelle Kennedy and Rosh Daji help to supervise (owner, 25 Oct 2026) but hold salesperson licences, so their checks count only once James Law reviews them. Decide (a) which salespersons each assistant checks, recorded in the supervision register, and (b) whether any of them should obtain a branch manager licence so that they can supervise in their own right and cover James Law's absences.
5. Anshari Saro is the Listing and Compliance Manager and AML/CFT compliance officer (JLR-04). The Drive JD (JD-AML-001) records the role as an employee reporting to the Principal, which meets AML/CFT Act s 56(2); confirm the employment agreement says so.
6. Deposits are held through the New Zealand Real Estate Trust operated with Public Trust (NZRET), handled by Azrin Affandi (owner, 25 Oct 2026); the company keeps no sales trust account of its own. Confirm with the auditor whether this meets REAA s 122 and whether the company files a trust account audit or a nil declaration each year (REAA s 125). Property management rent paid through the company cheque account and a suspense ledger is client money in an ordinary account: decide where it should be held (PROC-26). The Drive documents name Karissa as the Public Trust person: update them.
7. Franchise: the website advertises franchises. Franchisees are separate agents with their own licence and trust account; this manual covers the company only.
8. Decide whether Investment Consultants give any advice that needs separate authorisation under the Financial Markets Conduct Act 2013 or financial advice law.
9. Absence cover: no one else in the company can supervise a salesperson. Arrange in writing a back-up agent or branch manager (from outside the company if necessary) for James Law's leave, illness or travel, and a succession plan, because the company's licence depends on at least one officer holding an agent licence (REAA s 44(2)).
10. Because James Law is the sole director and holds most senior roles, name an external lawyer or adviser to whom the Compliance and Risk Manager can escalate a concern about him, and consider an independent adviser to the Board.
11. Confirm whether Anshari Saro, Zoey Linawati, Karissa or Azrin hold any REAA licence. The chart shows them as unlicensed, so none of them may carry out agency work (REAA s 6).
12. Prospect matching (JLR-26): phoning buyers to promote specific properties or arranging viewings is real estate agency work (REAA s 4, s 6), so it needs a licence, but a salesperson licence supervised by JLR-02 is enough; an agent licence is not needed. Decide whether the holder is a licensed salesperson (may phone buyers) or unlicensed (matching, consented alerts and booking appointments only).
13. Marketing: Eva Zhang has left (owner, 25 Oct 2026). JLR-73 Chinese Marketing Specialist is vacant and Kathy Liu (JLR-72) covers it. Decide whether to refill JLR-73 or merge it into JLR-72, and whether to fill JLR-70, JLR-71, JLR-75 and JLR-76.
14. The Drive catalogue (JD-HR-000) also lists a Sales Manager, Project Sales Manager, Project Sales Assistant and Talent Developer (all vacant) and calls Zoey the Sales Coordinator; this chart keeps Kim Diack as Sales Director and Zoey as Office and Operations Manager as instructed. Align the Drive JDs or this chart.
15. RESOLVED (owner, 25 Oct 2026): Karissa's full name is Karissa Joy Agkis, and Stefanus in email is the same person as Stiven Lai (JLR-77).
16. The Marketing Budget sheet shows free portal base listings at a price to make the company contribution look larger, and shows some Trade Me items at a rate the vendor is not charged. Remove both: a marketing budget must not mislead the vendor (Rule 6.4; Fair Trading Act 1986). Any supplier discount the company keeps must be disclosed (REAA s 128).
17. The 'ten days email' release route (one lawyer's email in place of signed authorities) conflicts with PROC-10's own rule. Decide whether to drop it or allow it only with JLR-02's written approval each time.
18. Deposits can now be receipted and sales set up while AML/CFT due diligence is still pending. Decide whether to block deposit instructions until JLR-04 approves AML (recommended: AML/CFT Act s 11, s 14).
19. Property management: the tracking workbook records a tenancy fee of one week's rent charged on a new tenant, and bonds lodged in twice-monthly batches. Check both against the Residential Tenancies Act 1986 (letting fees to tenants are banned; bonds must be lodged within 23 working days) before PROC-26 is adopted.
20. Write the missing procedures the Drive does not cover: deposit refund on a fallen deal, multiple offers, auction day, listing withdrawal with notice to the vendor, and an annual CPD record for every licensee (PROC-03).
